HARRISBURG, Pa. (Legal Newsline) - The Pennsylvania Supreme Court ruled last week that trial courts are not restricted to considering a single use of a multi-use product in design defect, threshold, risk-utility balancing.

The Court, in its March 22 opinion, affirmed the ruling of a superior court in a lawsuit over a medical device's use.

The device at issue is a linear cutting and stapling instrument. It is used in place of traditional scalpel and suture techniques in various surgical applications.

The decedent in the case, Sandra Selepec, underwent gastric bypass surgery in August 2002.

As part of the procedure, her stomach was transected to create a smaller pouch.

The surgeon used a product manufactured by Ethicon Endo-Surgery Inc., known as an ETS-Flex45 Articulating Endoscopic Linear Cutter or "endocutter."

The instrument was designed to be used in endoscopic surgery, or those less invasive procedures in which small incisions are made and a camera or light source is inserted.

However, it also was marketed to be used in more traditional surgery, as in Selepec's case.

During recovery, Selepec experienced complications, and surgeons reentered her abdomen.

They discovered that staples were absent in two small line segments, consistent with mechanical staple failure.

Doctors tried to repair the area, but leaked stomach contents fostered sepsis, a severe illness in which the bloodstream is overwhelmed by bacteria.

Selepec died.

Jeffrey K. Beard, as estate administrator for Selepec, sued Johnson and Johnson Inc. and Ethicon, which is a subsidiary of Johnson and Johnson, for product liability, including an asserted defective design of the endocutter.

A jury returned a verdict in favor of Beard, awarding Selepec's estate $5 million.

On appeal, a divided superior court panel vacated the award in a memorandum opinion and directed the trial court to enter judgment notwithstanding the verdict in Johnson and Johnson's favor.

The state's high court was asked, on appeal, to determine whether the superior court's threshold risk-utility analysis should be limited to the particular application alleged to have caused the plaintiff harm.

The Court also was asked to consider the degree to which an appellate court is bound by such weight and credibility determinations, as may be made by a trial court in a risk-utility assessment.

The Court, in its 28-page opinion, declined to "disturb" the superior court's legal determination as to the appropriate risk-utility "calculus."

"In terms of the appropriate focus of design defect risk-utility analysis, for many of the reasons identified by Appellee (Johnson and Johnson), we decline to limit it to a particular intended use," Justice Thomas Saylor wrote for the Court.

"For better or worse, this Court's decisions have relegated our trial courts in the unenviable position of 'social philosopher' and 'risk-utility economic analyst.' This having been done -- and as the present case does not provide an appropriate opportunity for reconsideration of such assignment -- we decline to require the trial courts to put on blinders.

"It should be enough to say that a product's utility obviously may be enhanced by multi-functionality, so that it would be imprudent to deny trial courts the ability to assign some weight to this factor in assessing product design."

Saylor added, "Moreover, Appellant (Beard) simply does not address why the other theories which may be available to a plaintiff, such as failure to warn, do not provide sufficient protection against deficient marketing and instruction practices."

Denis Smirnov explains: “Automation has always been at the top of the list of client requests for 1DCutX, and this new version brings it to life. Support of VBA automation provides a new way to perform optimization in 1DCutX. Instead of using standard dialog boxes invoked from the menu, users now can call the “Execute” method from VBA code and get the same results as before.”

Users just need to create an instance of the linear cutting class, assign settings and specify the ranges of cells containing the stock and parts information. The method “Execute” returns a text value that is empty if the calculation is done successfully; otherwise it returns an error message.

Automation allows users to tune-up the generated reports by including/excluding the graphical layouts, the part/stock matrix or the cutting instruction spreadsheets. The new version of 1DCutX comes with an automation guide that describes in detail how to create, set up and run the calculation using VBA. In addition, the installation provides a new example spreadsheet with simple VBA code that demonstrates automation in action.

With the initial investments of $97 users of 1DCutX reported monthly savings in materials alone range from $200 to $1500, which means the software pays for itself in less than a month. Free trial version of 1DCutX is available on Optimalon’s website.

Linear-Cutting

In this dissertation, a finitely convergent disjunctive programming procedure, the Convex Hull Tree CHT) algorithm, is proposed to obtain the convex hull of a general mixed-integer linear program with bounded integer variables. The CHT algorithm constructs a linear program that has the same optimal solution as the associated mixed-integer linear program. The standard notion of sequential cutting planes is then combined with ideas underlying the CHT algorithm to help guide the choice of disjunctions to use within a new cutting plane method, the Cutting Plane Tree CPT) algorithm. We show that the CPT algorithm converges to an integer optimal solution of the general mixed-integer linear program with bounded integer variables in finitely many steps. We also enhance the CPT algorithm with several techniques including a “round-of-cuts” approach and an iterative method for solving the cut generation linear program CGLP). Two normalization constraints are discussed in detail for solving the CGLP. For moderately sized instances, our study shows that the CPT algorithm provides significant gap closures with a pure cutting plane method. The user specifies additional ranges of cells containing diameters of the stocks and parts, and 1DCutX uses only such stocks that have the same diameter as required parts. For example, if part A1 has a diameter of 2 inches, then it will be cut only from stocks with a 2-inche diameter.

Combining diameters and material types allows even more flexibility. If a project requires cutting bars with different diameters from different materials, then the user specifies two ranges of cells: one for diameter and another for materials. For example, part A1 (2-inch diameter) needs to be cut from aluminum, and part B1 with the same diameter has to be cut from steel bars.

The clients used to run 1DCutX several times for each unique diameter or material type. Afterwards, the clients had to combine results from several spreadsheets into one. Linking parts and stocks by diameters or material types allows them to optimize the whole project at once, improving productivity and simplifying project management.
